Breaking news! It’s 2025, and Supreme Court lifts TRO off MMDA NCAP, No Contact Apprehension Policy

Yes, ladies and gentlemen, you read that right! The No Contact Apprehension Policy or NCAP for short is all set to return! It was in August 2022 that a Temporary Restraining Order (TRO) was issued by the Supreme Court, rendering the Policy inert, and a shade less than 3 years later, the TRO has “finally” been lifted. Here’s what we know so far.

August 30, 2022, saw the issuance of the TRO against the NCAP. Upon the Supreme Court’s order, all LGUs who use the Policy have agreed to cease from its implementation and enforcement until such time that a resolution has been reached – resolution enough to warrant the lifting of the TRO. The preliminary hearing was set for January 24, 2023, but since then, there was no sign of a lifting nor the Policy’s re-implementation.

The NCAP, since its inception, has had split reactions from the motoring public, with some agreeing and attesting to its effectivity to curb motorists’ misbehavior while the greater majority have bombarded the LGUs, MMDA, and even the LTO with claims and arguments on the illegality of the NCAP and how it has been weaponized by unscrupulous enforcers to extort money from the hapless motorists who have no idea that they’ve already been flagged for offenses.

There have been calls for the immediate lifting of the TRO on the NCAP, but as we all know, none of these have proved substantial enough.

While the lifting of the TRO inevitably means the re-implementation and the enforcement of the NCAP across all LGUs in and under the Metro Manila Development Authority’s jurisdiction, neither the MMDA nor the LTO has given a date as to when it will start, as of this posting.
