The Anti-Distracted Driving Act is now a law which would prohibit and penalize “distracted driving” like using your mobile or electronics devices while operating a vehicle.

Back in May, the Senate has approved on its final reading SBN 3211, or the Anti-Distracted Driving Act. Now a law, it is now assigned as Republic Act No. 10913.

According to the new law, distracted driving refers to the performance by a motorist of any of the following acts in a motor vehicle in motion or temporarily stopped at a red light, whether diplomatic, public or private:

• Using a mobile communications device to write, send, or read a text-based communication or to make or receive calls, and,

• Using an electronic entertainment or computing device to play games, watch movies, surf the internet, compose messages, read e-books, perform calculations, and other similar acts.

However, it is not considered as distracted driving if you’re not holding the mobile device like when in hands-free function, using the speaker phone, earphones and microphones. Provided, that the placement of the mobile device or hands-free device does not interfere with the line of sight of the driver.

There are a few exemptions to the provisions of the act:

• When used for emergency purposes such as an emergency call to a law enforcement agency, health care provider, fire department, or other emergency services, agency or entity; and,

• When operating an emergency vehicle such as an ambulance, fire truck, and other vehicles providing emergency assistance.

Violators of this act will be penalized with a fine of Php5,000 for the first offense, Php10,000 for the second offense, Php15,000 with suspension of driver’s license for 3 months for the third offense, and Php20,000 with revocation of driver’s license for the final offense.

  1. Pano na kaming Grab driver pag may pumasok na booking sa phone namin habang nagdadrive? 15 secs lang ang allotment time para iaccept ang booking ng pasahero namin. Obligado kaming pumindot sa phone pag may booking na pumasok sa phone.

  5. Shouldn’t they also ban LED outdoor displays? Is that the same as watching a movie? Isn’t it the outdoor LEDs are just as risky as watching on your phone?

    • Agree. Not to mention yung dami ng mga billboard ads sa kalsada ngayon. Kahit experienced defensive driver ako (on mulitple countries) nadidistract padin ako sa mga billboard natin lalo na yung LED signs na sobrang liwanag. Also kailangan ba every poste ng skyway may ad?

  9. guys how about an iPad 9.7as a mounted as a Dash Headunit? instead of pure music only which is boring specially when in traffic. I use my iPad as a AV Dash Headunit. to play MTVs and or Spotify. well its mounted in my Dashboard and I don’t hold it since its controllable in my steering wheel. since it plays MTV videos, will they categorize it as a distraction? or not? just like some other private cars and/or ubers that have TV boxes in their cars.

    well im not watching it naman while driving I just an entertainment lng naman pag naka stop and to be different since my car has abn ICE setup…

    • I guess it does not distract so long as you do not use it to watch videos. If you only use it to listen to music, then it is no different from the interactive dashboard in most new cars today.

      i’ve been following yugatech for some time and marami dito eh kung magreply sa mga tanong eh akala mo kung sinong perpekto! the reason why some people are asking questions is because hindi nila masyadong naintindihan, malabo sa kanila, or hindi clarified yung category or hindi stated yung yung tanong nila just like mine. so guys please respect naman and to other’s post as well thanks!!!

  11. Hi guys, to lapse means to deteriorate or expire. It also connotes something passive. Please use “passes into law” or “becomes a law” because this is an intentional, active act by the senate.

  12. I wonder if this bill also includes changing the car’s radio station or volume and viewing/changing channels of mounted LCD TVs while driving?

    • to “The Heck” and “Kwatog” you missed the point of his comment. His point is simple… bakit bawal mag-cellphone kung di naman bawal ang bumutingting ng radyo at TV sa kotse. Ayan, tagalog at straight to the point para maintindihan ninyo.
